Subpoenas, Court Orders & other legal action   

In the Case of Subpoena:

Teachable Moments Services Inc. (TMS), when subpoenaed and, whenever possible with the knowledge of the program participant, will provide documents required by Court Order.

Employees who have been subpoenaed will testify in court, if called. TMS may, if necessary, choose to consult with a lawyer prior to responding to a subpoena from the court.

Subpoenas should be accepted by the Administrative Director where possible and appropriate.  The Administrative Director will notify the person named on the subpoena and the Executive Director or designate.

Subpoenas may be served directly to individual staff. If a staff person is subpoenaed in relation to their role with the organization, the staff person shall:

  • Immediately inform the Executive Director.
  • Provide a copy of the subpoena to the Executive Director
  • Complete an Internal Incident Report form
  • Consult with the Executive Director regarding actions in response to the subpoena.


In the case of court order, including search warrants

Court orders, including search warrants, may be served to administrative staff or directly to staff working in a TMS facility.  In the event of a court order or search warrant, staff are to:

  • Comply with legal and reasonable direction given by a Peace Officer while conducting a search.
  • Immediately inform the Executive Director or designate.
  • Provide a copy of the court order to the Executive Director
  • Complete an Internal Incident report form
  • Consult with the Executive Director regarding actions in response to the court order or search warrant
  • In the event of a search warrant, staff should remain present during the search and make notes.  These notes should be included in the Internal Incident report.  Notes about the search, should include:
  1. Areas searched
  2. Names and badge number of officers conducting the search
  3. Any items removed
  4. Any comments or discussion pertinent to the search


In the case of lawful investigation, including police, child welfare and licensing investigations:

Staff involved in any lawful investigation at a TMS facility, involving TMS staff or participants and/or regarding TMS operations are instructed to:

  • Comply with legal and reasonable direction given by an investigating authority during the investigation.
  • Immediately inform the Executive Director.
  • Obtain and provide a copy of any documentation regarding the investigation to the Executive Director
  • Complete an Internal Incident report form
  • Consult with the Executive Director regarding actions in response to the investigation.
  • If the investigation involves an inspection of TMS facilities or interviews with either staff or participants, staff should remain present, make notes and include these in the Internal Incident report.  Notes about the search, should include:
  1. Areas searched and person interviewed.  Staff should request to be present during any interviews of participants and should ask to have another staff present if they are being interviewed.
  2. Names and positions of any persons conducting the investigation
  3. Any actions taken by investigators, including child apprehensions
  4. Any comments or discussion pertinent to the investigation
